What every student should know about Indiana
Borough Ordinances.
Here is a general overview of the ordinances
that most affect your daily life:
LOCAL ORDINANCES:
Alcohol
A person is guilty of a misdemeanor of the 3rd
degree if he/she represents himself to be 21 years of age to a
licensed dispenser of alcohol.
A person is guilty of a summary offense if he is younger than
21 and tries to purchase, consume, or transport any alcohol.
A person is guilty of a misdemeanor of the 3rd degree if he
or she knowingly, willingly, and falsely represents to any dealer
any minor to be of full age for the purpose of inducing any such
licensed dealer to sell or furnish intoxicating liquors to a minor.
It is a misdemeanor to unlawfully transfer an identification card
for the purpose of falsifying age to secure alcoholic beverages. It
is also a misdemeanor for any person to sell, furnish, or give to
any minor under 21 any alcoholic liquor.
Anti Noise
There is a 24 hour a day restriction on any noise
that can be heard 50 feet from its origination.
Bicycles
They are considered vehicles in PA so follow the same laws as
cars. They cannot be ridden on the sidewalks. Night riding requires
a light that can be seen from 500 feet and a red rear reflector.
Disorderly Conduct
Actions such as unseemly noise, indecent language, public
urination, damaging public or private property, and prowling may
carry fines. Serious cases can be prosecuted as misdemeanors.
Fireworks
Fireworks cannot be used in the Borough.
Garbage and Recycling
All garbage and recycling must be in containers and out of
public sight except for the 24 hour time before your neighborhood
pick up. There is a rotating schedule for pick up that must be used.
Recyclable items are glass, tin, and newspapers. Ask your landlord
for details.
Grass and Snow Care
If you live off campus, check your lease to see who is
responsible for keeping the grass cut and the snow cleared. Your
sidewalk must be cleared within 24 hours of the last snowfall.
Indoor Furniture
Cannot be places outside for use as outdoor furniture.
Leash Laws/Nuisance
Dogs must be on a leash at all times while on others'
property in the borough. All defecation must be cleaned up from
public and private property.
Nuisance Ordinance
Discourages repeat violations of the property maintenance
code in a 365 day period. Increasing fines, owner notification and
owner's occupancy license revocation can result. The purpose of this
ordinance is to address the issue of certain private properties that
require a disproportionate amount of attention from the Code
Enforcement Department in order to properly protect the Borough
citizen's health, safety, sanitation, and general welfare.
Open Container
It is illegal in the Borough to possess any open container of
an alcoholic beverage on any public property.
Parking
>Over the Sidewalk
Illegal if blocking the sidewalk.
>On the Grass
Prohibited except by permit from the borough office.
>Left Wheel to the Curb or Against the Flow of Traffic
Illegal in the Borough and throughout the state of
Pennsylvania.
>In Private Lots
It is the civil right of the lot owner to tow any illegally
parked car in their lot.
>Two Unpaid Parking Violations
Can lead to the possibility of your vehicle being "Booted".
Parking Permit
A permit for your car is needed to park on the signed streets
of Indiana Borough. Either you or your landlord is responsible for
obtaining this permit at the Borough Office.
Property Inspection
Indiana Borough reserves the right to inspect any non
owner-occupied property between the hours of 8:00 a.m. and 8:00 p.m.
Property Nuisance Ordinance
If offenses continue at the same location requiring an excess
of police and/or code enforcement services, the property is
considered a nuisance property. The host must pay the costs and
fines for the first and second offense occurring within 6 months of
the second one, the host and/or owner can be assessed the costs of
the services and fines.
Rollerblading
Rollerblading or skateboarding is not allowed on Philadelphia
Street between 5th and 9th streets. Elsewhere, use the sidewalk,
yielding to pedestrians.
Street Signs
It is unlawful to deface or steal signs.
